Please read carefully the following terms of use ("Terms") for the sarweather.com service ("Service"), provided by Institute for Meteorological Research (IMR). By using the Service, you agree to be legally bound by these Terms.

IMR reserves the right, at IMR's sole discretion, to change the Terms from time to time. Your continuing use of the Service constitutes your acceptance of and agreement to any changed Terms. We will post any such changes in a timely manner, and draw your attention to any significant changes on the home page.

IMR collects some personal information in order to provide its services. Please refer to our "Privacy Policy" for further information.

The Service

IMR provides, through sarweather.com, the user with the means to create a numerical weather forecast, on-demand, for any location world-wide.

Use of the Service

You may access the Service for your own personal or commercial use. You may not allow others to use your user details to access the Service.

You may not attempt to access any content, or use any feature of the Service that you are not entitled to according to your active subscription plan at the time.

We reserve the right to suspend or terminate the Service or any individual account at any time for operational, regulatory, legal or other reasons.

We may terminate your use of the Service with immediate effect if you breach any of these Terms.

Intellectual Property

All intellectual property right (including, but not limited to copyright, trade mark right and know-how) to the Service and any content on the webpage of IMR is held by IMR, except expressly stated otherwise, and purchase of the Service does not grant you any right to, or right to use, any such intellectual property rights held by IMR.

Except as expressly authorized by IMR, you agree not to copy, download, modify, rent, lease, loan, sell, distribute or create derivative works of any content of the Service, in whole or in part.

Third Parties

The Service may provide information on and links to other web sites or resources. You acknowledge that IMR is not responsible for the availability of such external sites or resources, and does not endorse and is not liable for any content, advertising, products, services or other materials on or available from such sites or resources.

Unless there is a clear indication otherwise, any dealings by you with any third party on or through the Service shall be solely between you and that third party and IMR shall not be responsible for any loss or damage that may arise from any such dealings.

SO FAR AS PERMITTED BY LAW IMR EXCLUDES ANY LIABILITY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OF THE SERVICE AND ANY INFORMATION DERIVED FROM THE SERVICE.

IMR MAKES NO WARRANTIES (EXPRESS OR IMPLIED) OR REPRESENTATIONS WITH RESPECT TO ANY WEATHER RELATED CONTENT OR MATERIALS OR SOFTWARE RELATED THERETO. IMR SHALL HAVE NO RESPONSIBILITY OR LIABILITY WHATSOEVER TO THE END USER OR ANY OTHER PERSON OR ENTITY FOR ANY INCONSISTENCY, INACCURACY, UNAVAILABILITY OR OMISSION FOR WEATHER OR EVENTS PREDICTED OR DEPICTED, REPORTED, OCCURRING OR OCCURRED. IMR DOES NOT HAVE ANY LIABILITY FOR THE CONSEQUENCES OF THE DECISIONS MADE BASED ON CONTENT RECEIVED OR NOT RECEIVED, OR INCORRECT OR DEFECTIVE CONTENT.

Privacy Policy

User information

In the course of using sarweather.com, you may be asked to provide IMR with certain personally identifiable information that can be used to contact or identify you and administer your account ("Profile"). Personal information may include, but is not limited to: Registration information including your name, user name, and password; contact information such as email, address and telephone number; and billing information such as credit card number.

IMR will log the geographical location of individual forecasts made by you, through the use of the Service.

IMR uses your Personal information to provide the sarweather.com services and administer your inquiries. Registration information is used for your authentication, contact information to provide you with information about IMR and billing information to charge you for the Service. We may also use your contact information to send SARWeather newsletters, marketing or promotional materials and other information regarding IMR/SARWeather that may be of interest to you. For further details on our mailing lists and policies see "Newsletter and notification email lists" below.

Please be aware that as a registered sarweather.com user, other users of the Services may be able to see your user name, in addition to any comments or submissions that you post to the site.

Use of website information collected

The information collected may be used to create an aggregate demographic profile of our user base so that we can customize the content and/or layout of our email messages or pages for each individual visitor, to notify you about updates to our web site and services, to send you our opt-in e-mail newsletter, to provide you with the products and/or services for which you signed-up or registered, which may include sending service disruption notices or other service- or product related information via email, and is not shared with other organizations for commercial purposes without your consent.

Newsletter and notification email lists

For each visitor that signs up for our email lists, we collect only the information that is requested on the list signup form. Our web servers may collect the domain name or IP address of visitors to our web page(s). Unless otherwise stated on our web site, we collect the email addresses of those who communicate with us via email and information volunteered by you such as but not limited to list signup information, survey information, and/or site registrations. We also may collect clickstream information.

If you subscribed to our e-mail newsletter but do not want to receive it in the future, please follow the "unsubscribe" instructions contained in the newsletter.

Return Policy

Cost of user credits is refundable, but users will have to pay the cost of credit card back-charging as decided by our payment service provider (currently 25US$).

General

These Terms constitute the entire agreement between you and IMR.

We may share collected information with another company in the event that IMR merges with or is acquired by another company.

Upon request, we will provide you with the information (e.g., email address, name, etc.) that we maintain about you.

Any failure by IMR to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.

Governing Law and Enforcement

These Terms are governed by the laws of Iceland.

By accepting these Terms you agree that the courts of Iceland are the most appropriate and convenient courts to settle disputes and accordingly you will not argue to the contrary.

The courts of Iceland have exclusive jurisdiction to settle any dispute arising out of or in connections with these Terms (including a dispute regarding the existence, validity or termination of these Terms). This clause is for the benefit of IMR only and as a result IMR is not prevented from taking proceedings against you in any other court with jurisdiction.
